1. General Overview & Scope
This Terms and Conditions Notice ("Terms") governs the use of travel facilitation and real estate consultancy services provided by Bluekites (hereinafter referred to as "Company", "We", "Us", or "Our"). By accessing our platforms, submitting an inquiry, or booking a service, you ("Client", "User") agree to be bound by these Terms.
2. Travel Services – Intermediary Role & Liability Disclaimer
* Intermediary Agent Status: Bluekites operates strictly as a travel facilitator and aggregator connecting clients with independent third-party vendors—including airlines, hotel operators, cab vendors, tour operators, and rail/bus service providers ("Travel Suppliers"). Bluekites does not own, control, or directly operate these travel services.
* Service Deficiencies & Operator Delays: Bluekites shall not be held liable for any flight delays, cancellations, overbookings, baggage loss, personal injury, property damage, accidents, route modifications, or service deficiencies attributable to third-party Travel Suppliers.
* Third-Party Terms & Conditions: All travel bookings are subject to the specific fare rules, cancellation terms, and operational guidelines of the respective Travel Supplier.
* Force Majeure: Bluekites is exempt from all liability and refund obligations for travel disruptions, missed connections, or cancellations caused by acts of God, extreme weather, natural disasters, epidemics, civil unrest, strikes, airport closures, government restrictions, or sudden regulatory shifts.
3. Real Estate Consultancy – Information & Advisory Disclaimer
* Advisory & Facilitation Nature: Bluekites acts solely as a real estate advisory and consultancy service connecting prospective buyers/tenants with property developers, property owners, and verified sellers ("Property Partners"). Bluekites is not a property developer, builder, or legal owner of listed real estate assets.
* No Warranty on Property Representations: While Bluekites makes reasonable efforts to verify property listings, all information—including property square footage, price estimates, architectural renderings, site amenities, completion timelines, and legal title statuses—is provided on an "as-is" basis as supplied by property developers/owners. Clients must independently perform legal due diligence, title searches, and physical property inspections before making financial commitments.
* Financial & Legal Disclaimer: Advice provided by Bluekites during real estate consultations does not constitute formal legal, tax, or financial advice. Bluekites disclaims all liability for financial losses, title disputes, construction delays, regulatory non-compliance (such as RERA delays by developers), or misrepresentations made by third-party property owners.
4. Limitation of Liability
To the maximum extent permitted by applicable Indian laws, Bluekites, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with:
* The default, insolvency, gross negligence, or breach of contract by any third-party Travel Supplier or Real Estate Developer.
* Any financial decisions, real estate transactions, or travel bookings executed based on informational content on Bluekites platforms.
In any event, the total aggregate liability of Bluekites for any proven claim shall strictly not exceed the actual service fee or administrative commission retained by Bluekites for that specific transaction.
5. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any legal dispute, claim, or proceeding arising out of or in connection with Bluekites travel or real estate services shall be subject to the exclusive jurisdiction of the competent courts having jurisdiction over the registered seat of the Company.
